Child Support

Jane-Ashley McMillan, Attorney at Law · Plano Child Support Attorney

In the State of Texas, the provisions of the Texas family code contain guidelines concerning child support. Under Texas law, child support is presumed to be proper if set at the following percentages:

  • 20% of net resources for 1 child;
  • 25% of net resources for 2 children;
  • 30% of net resources for 3 children;
  • 35% of net resources for 4 children;
  • 40% of net resources for 5 children;
  • Not less than 40% for 6 or more children.

Although uncommon, the court may deviate from these guidelines under certain circumstances.

Child Support Enforcement…

Sometimes, people ignore their child support obligations because they are angry and feel that their financial burden is unfair. Sometimes they are simply trying to 'get' their former spouse. And sometimes, financial circumstances can change drastically due to the loss of a job or illness and the money to fulfill these obligations is simply not there.

Regardless of the reason, non-payment of child support is prosecuted and could result in jail time.

If this is the situation you find yourself in, Jane-Ashley will work with the court system to find a resolution that may not include jail time.
